What factors decide how easily a flat in Bengaluru resells?
Direct answer: The next buyer, and that buyer's bank, resell a Bengaluru flat on papers and on what still works in the building. An occupancy certificate, a khata in a regular register, a clear encumbrance certificate and a readable undivided share matter more than a fresh coat of paint. Age matters once the five-year defect period is over, because lifts, waterproofing and the sinking fund then sit with the owners.
Verify with your lawyer: This is general guidance from public rules, not a legal opinion on your flat or site. Have your own property lawyer read the papers before you pay.
What are the key takeaways?
- A resale is a title transfer from an owner, so the OC, khata and encumbrance certificate do the heavy work.
- Guidance value can raise the buyer's stamp duty when it sits above the price. It does not set your sale price.
- After five years from possession, section 14(3) no longer makes the builder fix defects for free.
- A metro station that is open, and a road you have driven, belongs in the decision. A line on a map does not.
What does the next buyer's file actually need?
A resale is not a fresh launch. The RERA promoter duties that apply when you buy from a builder mostly fall away, and the weight moves to the seller's title. We set out that shift in what changes between a new launch and a resale. The papers a lawyer and a bank keep asking for are dull and decisive.
- Occupancy certificate for the building you are in, not a possession letter. The difference is in possession letter versus OC.
- Khata in the seller's name, and which register it sits in. Inside the city corporation area that record is now the e-Khata on e-Aasthi. An e-Khata can exist for a B-register property as well as a regular one, so read the register, not just the word e-Khata. Start with a search by PID.
- Encumbrance certificate for a long enough period, from Kaveri. It shows registered dealings. It does not show every court case. See how to download the EC and how a litigation check sits beside it.
- Undivided share written in the sale deed, not a verbal share of the land. What undivided share means is worth reading before you compare two flats.
Stamp duty on the next sale is charged on the higher of the price and the guidance value. A flat agreed below guidance value does not shrink the buyer's duty. That is a friction in the resale, and it is public. Your own price is a negotiation. This page does not quote one.
What has the building already used up?
Section 14(3) makes the promoter repair structural and workmanship defects you report within five years of possession. On a flat that is ten or twenty years old, that clock is finished. Lifts, terrace waterproofing, plumbing stacks, the generator and the sewage plant are the owners' problem, paid from maintenance and the sinking fund. The same list is written up for an older flat in Whitefield. Ask for the lift register, the last major repair, and the balance the association actually holds. Corpus and maintenance deposit are different pots. Unpaid dues of the seller usually travel with the flat unless the deed says they were cleared.
Carpet area, as the Act defines it, is the only figure that lets you compare two homes. Super built-up area is a sales number. If one listing is in carpet and the other is in super built-up, you are not looking at the same thing. How RERA defines carpet area is the conversion.
What does not travel into the next sale?
A brochure from the launch year, a promised metro that has no running train, and a verbal line about how fast the street will grow, do not bind the next buyer. What travels is the deed, the khata, the physical state of the common areas, and the commute you timed yourself. Banks financing an older flat look at the completion certificate, the seller's existing loan, and a valuation. The steps are in how a resale home loan differs. None of this produces a number for what your flat will fetch. It tells you which flats the next careful buyer can actually take.
Frequently asked questions
Does a missing RERA number kill an old flat's resale?
Not by itself. Section 3(2)(b) says a project that received its completion certificate before 1 May 2017 did not need registration. The live questions are the OC, the khata and the title.
Does a low asking price reduce stamp duty for the buyer?
No. Duty uses the higher of the price and the guidance value. A price under guidance value does not lower the duty.
Who pays for a lift replacement in a 15-year-old block?
The owners, through the association. The five-year defect period under section 14(3) has ended.
Should I compare flats on super built-up area?
No. Use carpet area. Super built-up area is not defined in the RERA Act.
