East Bengaluru buyer answers

How does a home loan for a resale flat differ from a new flat?

Direct answer: A resale flat is already built and owned by someone else, so there are no construction stages to pay against. The bank's checks move to the seller and the building: title, the sanctioned plan and completion certificate, any loan the seller still owes, and a valuation. RBI's rules let banks finance an old house.

Verify with your lawyer: This page explains published RBI rules, not legal advice. Have your own property lawyer check the seller's title, the plan and completion papers, and the sale agreement before you pay an advance or sign the loan documents.

With a new flat from a builder, the loan is paid out in parts as the building goes up, and most of the paperwork comes from one promoter. With a resale flat, you are buying a finished home from a person. The money question is simpler. The paper trail usually is not, because the bank now has to be satisfied about someone else's ownership, the building's approvals and any loan still sitting on the flat.

Does RBI allow banks to lend on an older flat?

Yes. RBI's Master Circular on Housing Finance (1 April 2025) lists the kinds of house loans banks may give. Para 2(B)(i) says banks "may grant loans to individuals for purchase/construction of dwelling unit per family". Para 2(B)(iv) says banks "may extend finance to a person who proposes to buy an old house where he is presently residing as a tenant".

Para 2(B)(ii) covers a second home: banks may finance a person who already owns a house "for buying/ constructing a second house in the same or other town/ village for the purpose of self-occupation".

So age alone does not rule out a loan. Each bank still sets its own credit policy on top of these rules, so ask your lender early whether it has any limit on the age of the building or the remaining loan tenure it will allow.

How is the payout different from an under-construction loan?

For a flat under construction, the loan is released in tranches linked to stages of work. Our page on home loans for under-construction flats walks through that.

A resale flat has no stages. Before you sign anything, ask the lender in writing:

  1. When it will release the money, and against which document.
  2. Who receives it: the seller, the seller's bank, or both.
  3. Which originals it will keep as security after the sale deed is registered.

Getting these answers on paper early keeps the registration day from turning into a scramble.

What will the bank check about the building?

Para 2(B)(vii) of the same Master Circular sets conditions that RBI introduced after Delhi High Court observations on unauthorised construction. For a ready flat, three of them matter most.

  • Your declaration. Under para 2(B)(vii)(d), when you take a loan "to purchase a built up house/flat, it should be mandatory for him to declare by way of an affidavit-cum-undertaking that the built up property has been constructed as per the sanctioned plan and/or building bye-laws and as far as possible has a completion certificate also."
  • The bank's architect. Para 2(B)(vii)(e) says an architect appointed by the bank "must also certify before disbursement of the loan that the built up property is strictly as per sanctioned plan and/or building bye-laws."
  • Unauthorised areas and use. Para 2(B)(vii)(f) bars loans on properties in unauthorised colonies "unless and until they have been regularized and development and other charges paid". Para 2(B)(vii)(g) bars loans on residential property the applicant plans to use for commercial purposes.

Notice that you are the one signing the affidavit. That is a good reason to get the sanctioned plan and the completion and occupancy papers from the seller before you agree a price. Our explainer on why OC and CC matter covers what those documents are. If the flat is in a panchayat area, see how to check BBMP or panchayat status.

What if the seller still has a home loan on the flat?

If the seller is still repaying a loan on the flat, ask whether the seller's bank holds the original title documents. If it does, that loan has to be closed and the charge removed before your bank can take the flat as security.

RBI's direction of 13 September 2023 on release of property documents applies to banks, NBFCs and housing finance companies. Para 2 says the lender "shall release all the original movable / immovable property documents and remove charges registered with any registry within a period of 30 days after full repayment/ settlement of the loan account." Para 6 adds that if the delay is the lender's fault, "it shall compensate the borrower at the rate of ₹5,000/- for each day of delay." The Housing Finance Master Circular, para 11(a), tells banks to follow this direction.

In practice, ask the seller for their bank's letter stating the amount needed to close the loan, and agree in the sale agreement how that amount will be paid and when the originals come to you or your bank. Your lawyer should draft that clause.

How do valuation and fees work?

The Master Circular says banks should have a Board-approved policy for valuing properties, including collateral, with valuation done by professionally qualified valuers. The bank's valuation, not the price you agree with the seller, is what it will lend against. Para 3 of the Master Circular caps how much of the property value a bank may lend. We do not quote those limits here, so ask your bank for the figure it will apply to your flat and its valuation.

RBI's Fair Practices Code for lenders (Master Circular on Loans and Advances, para 2.5) gives you some useful rights:

  • Banks "must inform 'all-in-cost' to the customer to enable him to compare the rates charges with other sources of finance."
  • They should give "acknowledgement for receipt of all loan applications."
  • If they reject you, they "should convey in writing, the main reason/reasons".
  • They should "invariably furnish a copy of the loan agreement along with a copy each of all enclosures quoted in the loan agreement to all the borrowers at the time of sanction / disbursement".

Ask for the all-in cost in writing before you compare two lenders.

How much of the value a bank can lend is covered in RBI's LTV and down payment rules.

What steps should I follow for a resale purchase with a loan?

  1. Collect the seller's papers first. Title chain, sale deed, khata, tax receipts, sanctioned plan, completion and occupancy papers, and the seller's loan details. Our list of documents to verify before a token advance is a starting point.
  2. Get your lawyer's title opinion. A consultant or bank check does not replace it. See why you still need a property lawyer for title.
  3. Apply to the lender with the papers. Ask for the all-in cost and the release terms in writing.
  4. Let the bank value and inspect. Expect its architect to compare the flat with the sanctioned plan.
  5. Settle the seller's loan in the agreed order. Make sure the originals and the charge release are covered in the agreement.
  6. Register the sale deed. Our guides to Kaveri 2.0 registration and paying stamp duty by e-stamp cover that day.

What this page does not cover

Stamp duty and registration charges, income-tax deductions on the loan, and TDS when the seller is an NRI are outside this page. For the last, see TDS when an NRI buys or sells a flat. Bank policies on building age, tenure and loan amount vary, and we do not quote them.

Frequently asked questions

Can I get a home loan for a 15-year-old flat?

RBI's Master Circular lets banks finance purchase of a dwelling unit, including an old house. Each bank then applies its own policy on building age and remaining tenure. Ask your lender for its rule in writing before you agree a price.

Will the bank pay the seller directly?

Ask your lender. A resale flat has no construction stages, so the bank will set out when it releases the money and to whom, which may include the seller's bank if a loan is still open. Get the payee details in writing before registration.

What if the resale flat has no completion certificate?

RBI's para 2(B)(vii)(d) asks you to declare that the flat was built as per the sanctioned plan and "as far as possible has a completion certificate also". Without one, that declaration is harder to make honestly, so talk to your lawyer before paying any advance.

How long can the seller's bank take to return the original documents?

RBI's 2023 direction says lenders must release original property documents and remove registered charges within 30 days of full repayment. If the delay is the lender's fault, it owes ₹5,000 for each day of delay.

Does the bank lend on the price I agreed with the seller?

The bank lends against its own valuation, done under its Board-approved valuation policy, and within RBI's limit on loan amount against property value. If its valuation comes in lower, you fund the gap.
