How do you find out if litigation is pending on a property before you buy it in Bengaluru?

Direct answer: An Encumbrance Certificate (EC) shows registered transactions, not court cause lists. To detect pending litigation, search all current and prior titleholders on eCourts across Bengaluru district courts, check High Court writ dockets, inspect Bhoomi RTC mutation records for revenue disputes, and have an independent property lawyer issue a title search report.

Verify with your lawyer: This is general guidance from public rules, not a legal opinion on your flat or site. Have your own property lawyer read the papers before you pay.

What are the key takeaways?

  • An EC is necessary and incomplete. Unregistered disputes stay off it.
  • Section 52 of the Transfer of Property Act makes a transfer during a suit subject to the result. You still have to find the suit.
  • Search every name in the title chain, not only the person selling this month.
  • A consultant can collect the PDFs. The opinion should come from your lawyer.

What does the encumbrance certificate leave out?

The EC from Kaveri is the list of registered instruments for the identifiers and the offices you searched. The steps are in how to download it. A registered mortgage shows up. A registered agreement shows up. A suit that nobody registered does not. That is why a clean EC is the start of a litigation check, not the end. If a lis pendens was registered, you will see that entry. If nobody registered it, the case can still exist.

Section 52 of the Transfer of Property Act, 1882 is the rule lawyers mean by lis pendens. A transfer while a suit about the property is pending is subject to the result of that suit. The section does not send you a letter. You have to look. A certified copy of each deed in the chain, from the Kaveri certified-copy service, tells you the names to search.

Where do you actually look?

  1. District courts. On eCourts, search the party name in the Bengaluru urban courts, and in any other district the land's history touches. Search the seller, the previous owners, and the promoter if there is one. Spellings drift. Try the way the name is written on the deed, not only the way it is written on the brochure.
  2. High Court. The Karnataka High Court hears writs against BDA acquisitions, khata orders and planning permissions. A district-court search does not include those. Use the High Court's case-status search for the same names.
  3. Revenue records. The RTC on Bhoomi shows mutations and, often, the disputes that reached the revenue file. How to read the RTC includes the mutation column. Do not skip it on a flat, because the land under the flat can be the thing that is in court.
  4. The project, if a promoter is selling. Karnataka RERA's project page lists complaints. A building with an open complaint is a different risk from a building with a clear page. What to read on that page includes the complaint tab.
Search Channel Public Jurisdiction / Authority Disputes & Liabilities Disclosed Critical Limitations
eCourts Portal & High Court Bengaluru Urban/Rural District Courts & High Court of Karnataka Title challenges, partition suits, specific performance suits, creditor claims, BDA writ petitions. Relies on accurate name spellings; newly filed suits or unindexed execution petitions may lag.
Kaveri 2.0 Encumbrance Certificate Department of Stamps & Registration (SRO) Registered sales, mortgages, court attachments formally registered, lease deeds. Completely misses unregistered disputes, unnotified court stay orders, and private family settlements.
Bhoomi RTC & Revenue Records Tahsildar / Assistant Commissioner Revenue Courts Agricultural inheritance challenges, survey boundary disputes, Section 79A/B proceedings, PTCL violations. Applies primarily to land origin / mother parcel; requires physical inspection of mutation registers.
Karnataka RERA Complaint Portal Karnataka Real Estate Regulatory Authority Project execution delays, developer diversion complaints, structural defect orders, non-refund petitions. Limited to RERA-registered projects; does not track individual civil inheritance disputes.

What should your lawyer add?

A search misses tribunals, execution petitions filed under a slightly different name, and cases in which the property is described but the party's name is a legal heir you have not listed. Your lawyer's search report is the document that says how far the search went and what it found. A consultancy can gather the EC, the deeds and the khata. It does not replace that opinion. Why the lawyer is still necessary is the boundary.

Ask the seller for a written disclosure of cases, and then search anyway. The disclosure is useful when it is false, because you have the sentence. It is not useful as your only check. If a case turns up, do not negotiate past it on a WhatsApp note. Ask what the prayer in the suit is, whether any interim order restrains sale, and whether your bank will lend on that fact. Many will not.

Frequently asked questions

If the EC is blank, is the property free of cases?

No. The EC shows registered documents for the search you ran. A suit that was never registered will not be on it.

Whom do I search?

Every owner in the chain, the promoter if there is one, and the names as they are spelt on the deeds. One spelling is not enough.

Does a RERA complaint show on the EC?

Not as a court case. Read it on the project's Karnataka RERA page. It is a different register.

Can the seller's affidavit replace the search?

No. Keep the affidavit. Still run eCourts, the High Court and the RTC, and have your lawyer say what was searched.
