Should you build a house on your site or sell it and buy a flat?
Direct answer: Build if the site has a clear khata, an approved layout, road and water access, and you can manage approvals and a contractor. Sell and buy a flat if the site lacks services or approvals, or you want shared security and upkeep. Selling a site can attract capital gains tax, with possible relief if you reinvest in a house.
Verify with your CA: capital gains on the site sale, whether section 54F relief applies when you buy or build a house, and the renumbered section under the Income-tax Act, 2025.
Verify with your lawyer: the site's khata, layout approval and title before you build or sell, and the title and approvals of any flat you buy.
Many families in Bengaluru own a site bought years ago in a layout that has only now filled in. The choice between building and selling is partly about money and partly about time, effort and the kind of home you want. This page sets out what to check on both sides.
What does building on your site involve?
- Approved layout and khata. Lenders and plan approvals need these. Check the khata on e-Aasthi (GBA) or e-Swathu (panchayat). See e-Aasthi search and Form 11A and 11B.
- Building plan approval from the local authority, based on the site size and the zoning.
- Construction contract with a contractor or architect-led team, with drawings, a bill of quantities and payment stages.
- Utilities: water, sewage and power connections. See BESCOM permanent power and BWSSB connection.
- Time: a typical standalone house takes many months from plan approval to completion. Plan your rent or current home for that period.
- Your time: someone needs to visit the site, approve materials and check work.
What does selling and buying a flat involve?
- Sale of the site: title, khata and EC ready for the buyer; capital gains on the profit.
- Purchase of a flat: RERA checks, OC, GST if under construction, and 7.6% stamp duty and registration. See hidden costs.
- Shared upkeep: lifts, security and common areas are shared through maintenance charges.
How is the sale of a site taxed?
A site held for more than 24 months is a long-term capital asset.
- For transfers on or after 23 July 2024, long-term capital gains on land are taxed at 12.5% without indexation, under the Finance (No. 2) Act, 2024.
- For land acquired before 23 July 2024, a resident individual or HUF can compute the tax at 12.5% without indexation or 20% with indexation, and pay the lower.
- Section 54F of the Income-tax Act, 1961 gives relief when you sell a long-term asset other than a house and invest the net sale amount in one residential house within the time limits. The relief is capped, and conditions apply on other houses you own.
The Income-tax Act, 2025 has applied from 1 April 2026 and renumbers these sections. Ask your CA which provision covers your sale.
Worked example (illustrative figures). You bought a site for ₹20 lakh and sell it for ₹90 lakh with ₹1 lakh in costs. The gain is ₹69 lakh. At 12.5% without indexation, tax is ₹8.63 lakh before surcharge and cess. If you invest the whole net sale amount in a flat and meet the conditions, section 54F relief may reduce this. Your CA will compute the exact figure.
How do the costs compare?
Build costs depend on design, materials and the contractor, so get two or three written quotes with the same drawings. For the flat route, add:
- GST at 5% for an under-construction flat that is not affordable housing, as per the GST Council's 2019 decision; nil if the whole price is paid after the completion certificate or first occupation;
- stamp duty and registration at 7.6% of the value (including the 2% registration charge from 31 August 2025);
- parking, deposits and maintenance.
For the build route, add plan approval charges, utility connections, the architect's charges and a contingency.
How does location change the answer?
East Bengaluru: sites in older layouts near Whitefield or KR Puram may now have roads and water, making building practical. Sites further out, around Varthur, Gunjur or Budigere, may still lack services. See Budigere Cross water and civic status.
North Bengaluru: sites near Yelahanka and the airport road may benefit from future rail links, reported for 2027 to 2030. That can make holding or building more attractive if you can wait.
South Bengaluru: sites near Electronic City or Kanakapura Road. The Yellow Line runs to Electronic City; check the land status and conversion carefully on newer layouts. See Kanakapura Road first steps.
What questions should you answer before deciding?
- How long can you wait? Building can take a year or more, plus approvals. A ready flat can be moved into after registration.
2. Do you want to manage a contractor? Building needs regular site visits, payments by stage and checks on quality.
3. Does the site have a clear title and khata? If not, sorting it out comes first.
4. Is your loan approved? Banks lend differently for construction and for a flat.
What mistakes do owners make?
- Underestimating approval time and cost.
- Not budgeting for water and power connections.
- Selling the site without planning for capital gains tax.
- Comparing building cost with a flat's base price instead of its all-in cost.
Checklist for the decision
- Confirm the site's khata, layout approval and title.
- Check road, water, sewage and power at the site today.
- Get two or three construction quotes with the same drawings.
- Estimate months of rent during construction.
- Ask a CA for the capital gains and section 54F position.
- If buying a flat, run RERA, OC and EC checks.
- Compare the monthly upkeep of a house with a flat's maintenance.
Frequently asked questions
Frequently asked questions
Can I get a home loan to build on my own site?
Many lenders offer construction loans on an owned site with an approved plan and clear khata. Ask two or three banks what documents they need before you apply for plan approval.
Is it cheaper to build than to buy a flat?
Sometimes, because you already own the land. But add plan approval charges, utility connections, rent during construction and your own time. Compare totals, not just the build quote.
Will I pay tax when I sell my site?
Long-term gains on land held over 24 months are taxed at 12.5% without indexation for sales on or after 23 July 2024. Resident individuals with older land may choose 20% with indexation. Ask your CA.
Can I avoid capital gains by buying a flat?
Section 54F may give relief if you invest the net sale amount in one residential house within the time limits and meet the conditions. The relief is capped. Your CA should confirm.
What if my site is in a panchayat area?
Check that the layout is approved and the e-Swathu record is in order. Without these, plan approval, loans and resale can be harder. Ask your lawyer first.
How long does it take to build a house?
It depends on the design, approvals and contractor. Plan for approvals first, then construction, and ask your architect for a realistic schedule.
