East Bengaluru buyer answers

Villa vs apartment in East Bengaluru: what actually changes?

Direct answer: In the villa vs apartment choice, the real difference is what the deed gives you. An apartment gives you a unit plus an undivided share of the land. A villa may give you a marked plot, or just a bigger undivided share. Check that first, then compare land per rupee, upkeep per home and approvals.

Key takeaways

  • Ownership: a flat comes with an undivided share; a villa may come with a marked plot or an undivided share. Read the deed's schedule.
  • Same regulator: RERA's definition of "apartment" covers villas too, so both must be registered unless the project is small enough to be exempt.
  • Land share: in our example, the same budget buys about three times more land in a plotted villa than in a flat.
  • Upkeep: fewer homes share the common costs, so in our example each villa pays five times what each flat pays.
  • Our ROOF check: rights, obligations, outgoings, future.

In Whitefield, Varthur, Sarjapur Road and out towards Hoskote, gated villa communities sit next to apartment towers, sometimes at overlapping prices. The brochures compare clubhouses. This page compares what you legally own and what it costs to keep. For the approvals, see our villa project checks.

What do you own in each?

An apartment. You own the flat and an undivided share of the land and common areas, held with every other owner. The Karnataka Apartment Ownership Act 1972 sets out how that share and the owners' association work.

A villa. It depends on the deed:

  • Marked plot: a defined piece of land with its own boundaries and, usually, its own khata. It's closer to owning a house on a plot.
  • Undivided share: the villa is legally structured like a flat. You own the building and a share of the whole site, not the ground under your feet.

Both are "apartments" for RERA. Section 2(e) of the Real Estate (Regulation and Development) Act 2016 covers any self-contained unit "by any other name". Section 3(2)(a) exempts projects on up to 500 sq m of land, or up to eight units. Check registration on Karnataka RERA.

How do the legal checks differ?

Check Apartment Villa (marked plot) Villa (undivided share)
Land title and conversion Whole site Whole site, then your plot Whole site
Layout approval Not usually Yes, with your plot number Sometimes
Building plan One for the block Per villa or per phase Per villa or per phase
Occupancy certificate For the block For each villa For each villa
Khata Flat-wise Plot-wise Often unit-wise
Association Apartment Act Varies; ask Apartment Act, often

Our approvals guide explains each authority, and OC and CC explained covers why the occupancy certificate matters. Have a lawyer read the deed's schedule before you pay an advance.

How much land does your money buy?

Worked example 1: land per rupee. Two homes cost about the same. The flat comes with a 400 sq ft undivided share. The villa comes with a marked 1,200 sq ft plot. Use an illustrative guidance value of ₹50,000 per sq m for the land (look up the real one on Kaveri).

Flat Villa (marked plot)
Land 400 sq ft UDS 1,200 sq ft plot
In sq m (÷ 10.764) 37.16 111.48
Land at ₹50,000/sq m ₹18.58 lakh ₹55.74 lakh

The villa buyer gets three times the land on paper. That matters for resale and rebuilding, because land doesn't depreciate the way a building does. But it only holds if the plot is truly yours. With an undivided share, a 1,200 sq ft figure is a share of everything, not a fenced plot. Our guidance value page explains how the official rate differs from the market price.

What does upkeep cost per home?

Worked example 2: shared costs. Say an apartment complex and a villa community each spend ₹6 lakh a month on security, gardens, the clubhouse, staff and common power. These are illustrative figures.

Apartment complex Villa community
Common costs per month ₹6,00,000 ₹6,00,000
Homes sharing them 300 60
Per home per month ₹2,000 ₹10,000
Per home per year ₹24,000 ₹1,20,000

Villa communities also tend to have longer roads, more boundary wall and more pipes per home. Against that, a villa owner may maintain their own roof and walls, while a flat owner shares the building's lifts, pumps and facade. Ask each association for the last year's accounts rather than trusting a per-sq-ft figure.

The ROOF check (our framework)

  1. Rights. Marked plot or undivided share? What does the schedule describe?
  2. Obligations. Which approvals cover your unit: layout, plan, OC? Who repairs what?
  3. Outgoings. What are the real annual association costs, divided by the actual number of homes?
  4. Future. Can you rebuild, extend or sell your unit alone, and what happens when the building ages?

Frequently asked questions

Is a villa the same as an apartment under RERA?

Yes, for registration. RERA's definition of apartment covers any self-contained unit "by any other name", so villa projects must register unless they fall under the 500 sq m or eight-unit exemption.

Do I own the land under a villa?

Only if the deed gives you a marked plot with boundaries. Many villa projects sell an undivided share of the whole site instead, which works like a flat's share.

Is maintenance higher for a villa?

Often, per home, because fewer homes split the common costs. In our illustrative example, ₹6 lakh a month split across 60 villas is ₹10,000 each, against ₹2,000 across 300 flats.

Does a villa hold value better than a flat?

It can if you own a real plot, because land doesn't wear out the way a building does. That depends on the location and title, so check the deed and resale demand nearby.

What approvals should a villa have?

Land conversion, layout approval for plotted projects, a building plan, a commencement certificate, RERA registration where required and an occupancy certificate for each villa.

What is the ROOF check?

It's our four-part comparison: rights in the deed, obligations for approvals and repairs, real annual outgoings, and future options to rebuild, extend or sell.
