Apartment or independent house in Bengaluru: how do you choose, and how do you buy the house?

Direct answer: In Bengaluru, choosing between an apartment and an independent house hinges on title structure and municipal compliance. An apartment conveys undivided land share (UDS) with shared amenities and statutory OC protections. An independent house conveys exclusive land ownership, requiring verification of layout approvals, DC conversion, building sanctions, and setback bye-law deviations.

Verify with your lawyer: This is general guidance from public rules, not a legal opinion on your flat or site. Have your own property lawyer read the papers before you pay.

What are the key takeaways?

  • An independent house needs the site's papers and the building's papers. An apartment needs the building's.
  • Match the floors you can see to the sanctioned plan, not to the neighbour's house.
  • A 600 square foot site is about 56 square metres. Setbacks and coverage depend on the plot and the road width.
  • BESCOM and BWSSB should be in the seller's name, and the khata should be ready to move.

What do you own in each case?

In an apartment you own the unit and a share of the land, held with the other owners. You do not own a piece you can fence. The association maintains the structure, and the occupancy certificate is for the building. Undivided share is the land part of that bargain. A villa can look like a house and still be only a share. Villa or apartment shows how to read the schedule.

Comparison Parameter Gated Community Apartment Independent House / Villa on Private Site
Land Ownership Structure Undivided Share of Land (UDS) jointly held across all apartment owners. 100% exclusive freehold land title ownership of the underlying demarcated plot.
Municipal Approvals & Setbacks Master sanctioned building plan and formal Occupancy Certificate (OC). Individual BBMP building sanction; high risk of setback violations and unauthorized extra floors.
Security & Shared Infrastructure 24/7 security guards, CCTV surveillance, automated DG power backup, clubhouse. Self-managed perimeter security, personal inverter/DG setup, private water sump maintenance.
Water Supply & Waste Disposal Bulk BWSSB water connection combined with on-site sewage treatment plant (STP). Direct municipal water line or private borewell; connected directly to public road sewer line.
Resale Liquidity & Secondary Market High secondary liquidity in established tech corridors with active rental yield demand. Larger lump-sum capital requirement; smaller buyer pool and longer sales cycles.

An independent house is the other object. The site is yours, within the conditions of the layout, and the building on it is yours. You also inherit whatever is wrong with both. If the land was agricultural and was never converted, the house is standing on land the revenue record does not treat as a residential site. If the layout was never approved, the khata may be Form 11B or a B register, which is tax without approval. Flat or plot is the land half of this choice. The city-versus-outskirts version is in apartment or outskirts bungalow.

How do you buy an independent house?

  1. RTC for the survey number, then the conversion order if the land was ever agricultural. Reading the RTC.
  2. The layout approval, naming the authority that issued it, and the khata. City sites on e-Aasthi, panchayat sites on e-Swathu. Certificate, extract and e-Khata are not interchangeable words.
  3. The sanctioned building plan and the occupancy certificate, matched to the floors and the setbacks you can see. A house that is bigger than its plan is a problem at the next loan and at the next sale.
  4. Encumbrance certificate and a litigation search on the owners in the chain. Where cases hide.
  5. Property tax paid, and BESCOM and BWSSB in the seller's name. After registration, transfer the connections and move the khata. The mutation path is the same idea for a house as for a flat.
  6. Your lawyer drafts the sale deed with the right schedule: site measurements, boundaries, and the building. Then you register it on Kaveri.

What changes on a site of about 600 square feet?

Six hundred square feet is about 56 square metres. Bengaluru's building rules tie setbacks, coverage and height to the plot size and the width of the road. On a very small site a new sanction is often tighter than the house already standing, which may have been built to an older rule or to no rule. This page will not invent the metre of setback for your road. Take the sanctioned plan and the site measurement to an architect and ask what could be approved today if the house had to be rebuilt. A floor the neighbour added is not your approval.

Compare that with an apartment of a similar carpet area. In the apartment the land under you is a fraction, the certificate covers the block, and you cannot enlarge the flat. In the house the land is yours and the rebuilding risk is yours. Neither is a prize. The one to buy is the one whose plan, khata and road you have checked, and whose commute you have driven.

Frequently asked questions

Is an independent house free of RERA?

A single house you buy from an owner is a resale of that house. A promoter selling houses in a project may still need registration under section 3, unless an exemption applies.

What if there is no sanctioned plan?

Treat that as a stop. The occupancy certificate and a regular khata are unlikely to exist either, and a bank may refuse the loan.

Can I rebuild the same house on a 600 square foot site?

Maybe not. Current setbacks depend on the plot and the road. Ask an architect against the current bye-law before you pay for a house you plan to knock down.

Do I need an occupancy certificate for a house?

Yes. The certificate permits occupation. It is not limited to large apartment societies.
