What do you actually get when you buy a BDA flat in Bengaluru?
Direct answer: A BDA flat, when the Authority is the one allotting it, is a statutory allotment under the BDA Act and its rules, not a private promoter's launch. You get the Authority's terms in a notification, and you still need a conveyance, a khata and an occupancy certificate for that flat. Allotment letters are not deeds. BDA layouts also get delayed and reshuffled. Check the scheme number against the building you are shown.
Verify with your lawyer: This is general guidance from public rules, not a legal opinion on your flat or site. Have your own property lawyer read the papers before you pay.
What are the key takeaways?
- The seller being BDA is a different file from a private builder. It is not a reason to skip the deed.
- Rule 14 has restricted how allottees transfer. Read the condition before you assume you can sell.
- BDA has moved allottees between layouts. The 30 January 2025 Arkavathi randomisation is a public example.
- If BDA is selling a project that section 3 covers, the RERA page should show it.
What does the allotment give you?
The Bangalore Development Authority is a creature of the BDA Act, 1976. When it builds flats and allots them, the offer is in a notification and an allotment letter, under its rules, with a price the notification states and conditions on who can hold the flat. That is more public than a private booking form. It is also slower, and it is subject to the land actually being available. BDA's allotment section is where those schemes are announced. A flat you are shown in a BDA complex should match a scheme you can find there, not only a board at the gate.
Development authorities can fall inside the RERA Act's definition of promoter when they sell. If this scheme is a project section 3 requires to be registered, it should be on rera.karnataka.gov.in. If it was completed and certificated before 1 May 2017, section 3(2)(b) is the reason it may be absent. How to tell those cases apart. Absence from the portal is not, by itself, either a comfort or a defect.
What does the allotment not close?
The allotment letter is not a sale deed. Title still has to be conveyed and registered. The three documents do different jobs. Until conveyance, you hold the Authority's allotment, on its conditions. The rules have long limited alienation. A 2024 amendment dealt with some older transfers that broke those conditions. Do not plan a quick resale off an allotment letter you received last month.
Layouts slip. On 30 January 2025 BDA randomised alternative sites from Arkavathi Layout into Nada Prabhu Kempegowda Layout. That was sites, not flats, and it is still the right warning: the Authority does reassign people when a layout is stuck. Ask whether your flat's scheme has a court case, and run the names through the check in pending litigation. The Shivarama Karantha Layout notification of 31 August 2026 itself travelled with litigation. The site procedure describes that notification. A flat scheme can be in court for the same kinds of reasons: acquisition, compensation, and who was entitled to be allotted.
You still want the occupancy certificate for the block, the khata in the allottee's name after conveyance, and an encumbrance certificate. The Authority's letterhead does not produce those on its own.
How is a BDA flat different from a BDA site?
A site allotment gives you land, and you build, subject to a plan. A flat allotment gives you a unit the Authority has built or is building, with common areas and the usual limits on altering the structure. Maintenance of those common areas has to land somewhere, either with the Authority for a time or with an association. Ask which, and ask for the accounts. A private builder who says the land is BDA land is not selling you a BDA flat. Ask who the allottee is, and whether BDA has permitted the transfer.
Frequently asked questions
Is a BDA flat safer because the Authority is the seller?
You are dealing with a statutory body and a published scheme. You still need the conveyance, the khata, the occupancy certificate and a check for litigation. The letterhead is not those documents.
Can I sell a BDA flat as soon as I am allotted?
The allotment rules restrict transfer. Read the condition in your letter. An allotment is not a sale deed you can flip.
Why is the scheme not on Karnataka RERA?
It may predate the Act and hold a completion certificate, or it may be a gap. Ask which, and read section 3(2) with your lawyer.
Is a flat on BDA-approved land the same thing?
No. BDA approval of someone else's layout is not an allotment by BDA. The seller should be the Authority, or an allottee BDA has allowed to transfer.
