Is it sensible to buy a Bengaluru flat while RERA registration is still in process?

Direct answer: A project whose Karnataka RERA registration is only in process is not registered. Section 3 of the RERA Act bars a promoter from advertising, booking or selling a unit that needs registration until registration is granted. A bank's willingness to consider a home loan, including a line you were told a public-sector bank would fund, does not replace that registration. Nearing completion is not, by itself, an exemption.

Verify with your lawyer: This is general guidance from public rules, not a legal opinion on your flat or site. Have your own property lawyer read the papers before you pay.

What are the key takeaways?

  • In process is not a registration number you can open on rera.karnataka.gov.in.
  • Section 3(2) lists the real exemptions: a small project, a completion certificate from before the Act, or renovation with no new allotment.
  • A sanction letter can still block disbursement until the registration number exists.
  • More than ten per cent of the price, before a registered agreement, is a separate breach of section 13.

What does section 3 require before anyone sells?

Section 3(1) of the Real Estate (Regulation and Development) Act, 2016 says the promoter shall not advertise, market, book, sell or offer for sale any plot, apartment or building in a project that needs registration, without registering it. Karnataka RERA hosts the Act. A granted registration has a number, a promoter, a land description and a completion date. An application that is still in scrutiny has none of those for you to match. Our note on paying before registration is the same rule at an earlier stage. A tower that already looks tall does not get a softer section.

Section 13 is the next line. The promoter cannot take more than ten per cent of the cost as an advance before a written agreement for sale is registered. Read which booking-form clauses to check before any token leaves your account.

When is registration actually not required?

Section 3(2) exempts three kinds of work. The land does not exceed five hundred square metres, or the apartments do not exceed eight, counting every phase. The promoter received a completion certificate before the Act commenced on 1 May 2017. Or the work is renovation or redevelopment that does not market a new unit. A large building nearing completion, with more than eight apartments, is not on that list because the plaster is done.

Karnataka's Rule 4 also narrowed what counted as an ongoing project when the rules were notified. The exclusions include some projects where an application for a completion or occupancy certificate had already been filed, and portions that already held a partial occupancy certificate. That is a 2017 test for work that was already underway. It is not a sticker a sales desk can put on a fresh application. If they claim an exemption, ask for the certificate or the application, with dates, and have your lawyer read them. The separate page on a flat that is not on RERA but has an occupancy certificate is that case. This page is the other one: the promoter is still trying to get on the register.

What does a bank's project clearance not do?

Banks keep approved-project lists so they know which buildings they will lend on. That list is a credit decision. It is not an order of Karnataka RERA, and it does not satisfy section 3. A sanction letter is an offer with conditions. Disbursement comes later, and it can wait for a clearance the letter names. We have set out why sanctioned money may not be released. Ask the branch, in writing, whether the first disbursement needs the RERA number. Do not treat a spoken line that a named bank will fund the flat as the registration.

If you still want the flat, wait until the number is on the project page, match the promoter and the tower, and read the quarterly update before you look at the agreement. A building that looks finished can still be missing the occupancy certificate. That document is explained in what OC and CC mean.

What should you ask for before you pay?

  1. The application acknowledgement, and a plain answer on whether registration has been granted.
  2. The sanctioned plan, the commencement certificate, and any occupancy or completion certificate already issued for your tower.
  3. The draft agreement, held against Karnataka RERA's proforma.
  4. The bank's condition list, not a sales sentence about which bank will lend.

Frequently asked questions

Can I book because the project is almost complete?

Completion does not replace section 3. Unless an exemption in section 3(2) or Karnataka Rule 4 actually applies, the promoter should not be selling until registration is granted.

Does a bank's project approval mean RERA registration is a formality?

No. The bank's list is its own lending filter. Registration is the Authority's act. One does not stand in for the other.

What if they already took more than ten per cent?

Section 13 required a registered agreement before that money. Put the dates and receipts in front of your lawyer, and read how a cancellation and refund works if the promoter is in default.

Where do I see that the number is real?

On rera.karnataka.gov.in. The promoter name, the survey numbers and the phase should match the papers in your hand.
