East Bengaluru buyer answers

When does property tax start on a new flat in Bengaluru, and who pays it?

Direct answer: Inside Bengaluru corporation limits, tax on a constructed building is usually linked to lawful occupancy, often marked by the occupancy certificate, not by booking day. After conveyance, the khatadar or person primarily liable pays on the official property-tax portal. Confirm your PID and demand there, not via a broker forward.

Verify with your CA: This page is not tax advice. Have your own chartered accountant confirm any tax amount, due date or treatment for your flat before you pay.

Verify with your lawyer: When tax liability shifts from promoter to you, and how OC delay interacts with demands, is fact-specific. Have your own property lawyer read any BBMP/GBA notice before you pay arrears under protest or ignore them.

Buyers often ask, "From which month do I owe property tax on this new 3BHK?" The honest answer is not "from booking" and not always "from possession letter day". Inside Bengaluru's corporation framework, tax on the building and tax on vacant land are different problems, and the occupancy certificate sits in the middle of that story.

When does tax on the building usually begin?

A useful public marker is the occupancy certificate (OC). In M/s B M Habitat (Karnataka High Court), the Court quashed a backdated BBMP demand that tried to tax the constructed building from a completion date years before OC. The Court reasoned that, on the facts of that case, the building became exigible for property tax from the OC date (25 April 2011 in that matter), and that until then incidence would be on vacant/open land rather than the constructed building, absent proof of earlier occupation (LiveLaw report of the judgment).

Caveats (read these):

  • That is case-law reasoning summarised from secondary reporting, not a statute section we quote here. Your facts may differ if the building was occupied earlier or if a different local law applies.
  • Whether every tower in every ward is assessed exactly from the OC date isn't settled in public sources; ask your lawyer about yours.
  • OC still matters for many other reasons, khata, bank formalities, resale. See why OC and CC matter.

Who pays after I take possession?

Once you are the owner on record (registered sale deed) and khata stands in your name, or you are otherwise the "person primarily liable" under the governing Act, you file the return and pay. Until mutation finishes, promoters sometimes keep paying (or claim they do). Do not assume. On possession day, collect:

  1. Latest property-tax paid receipt for the mother assessment / apartment PID
  2. Written statement of arrears, if any
  3. Timeline for khata transfer into your name
  4. Association rules on who remits tax for common areas vs individual flats

Section 11 and 17 RERA duties around handover and conveyance still sit in the background (RERA Act text hosted by K-RERA); they do not replace municipal tax law.

How do I pay online inside corporation limits?

The Bengaluru City Corporation property-tax service is advertised on bbmptax.karnataka.gov.in. Portal copy describes:

  • Generation / use of Property Identification (PID) / SAS ID
  • Display of demand, arrears, rebates or penalties under the Greater Bengaluru Governance Act, 2024 and its Rules
  • Online payment via net banking, cards, UPI and other gateway modes
  • Receipt generation and record update

What do the instalment rules say?

Section 148 of the Greater Bengaluru Governance Act, 2024 provides that the person primarily liable shall file a return and pay property tax in two equal instalments, due by end of May and end of November of the financial year, with an option to pay in a single instalment. Paying the full year within one month of the financial-year start can attract a rebate "not exceeding five percent" as notified (section text). For the rebate rate that applies this year, read the current notification on the tax portal.

What if sales staff say "tax starts only after khata"?

Khata and tax are related but not identical. You can receive a demand against a PID before your individual khata finishes. You can also hold a khata and still have arrears from a previous assessment year. Ask for the PID number in writing at handover and search it yourself on the portal.

Which edge cases catch East Bengaluru buyers?

  • Tower OC pending, keys offered. Paying tax (or being asked to) without OC is a red flag for other processes too. Read OC/CC and talk to your lawyer before you treat possession as final.
  • Project straddling jurisdictions. Parts of East Bengaluru still sit under gram panchayats or recently transitioned areas. Confirm whether your flat is corporation or panchayat before you use the BBMP portal, see BBMP or panchayat check.
  • Association bulk payment. Some societies collect flat-wise tax and remit. Keep your own receipt copy either way.

What does a typical timeline look like?

  1. At booking: no building property tax for you yet; focus on agreement terms (documents before token).
  2. Near possession: demand OC status and last tax receipt.
  3. After sale deed: apply for khata / name change with your lawyer.
  4. After PID is in your control: file return and pay on the official portal by the statutory due dates.
  5. Every year: diary May and November instalments (or the single-payment rebate window).

Frequently asked questions

Does property tax start from the booking date?

No. Booking and agreement-for-sale stages are not the usual trigger for building property tax. Watch OC, khata mutation and the portal demand instead.

Who pays tax before I get the sale deed?

Often the promoter or the association arrangement shown in your agreement still carries dues until conveyance and khata change. Ask for written proof of tax paid up to handover, then mutate khata into your name with your lawyer's help.

Can I pay BBMP property tax online?

Yes, through the Bengaluru City Corporation / BBMP property-tax portal at bbmptax.karnataka.gov.in when your property is within corporation limits. Keep the receipt PDF.

What if my flat is still under a gram panchayat?

Corporation portal rules do not apply the same way. Panchayat areas use e-Swathu / BSK / local panchayat channels. First confirm jurisdiction. See how panchayat property tax is paid for a flat.

Are there instalment due dates?

Under Section 148 of the Greater Bengaluru Governance Act, 2024, property tax is due in two equal instalments by end-May and end-November of the financial year, with an option to pay in one instalment and a possible rebate if paid early as notified. Confirm the live rebate rate on the portal.
